Carlos Moncayo was a 22-year old worker who died in a 2015 trench collapse. Throughout the investigation, it was evident that the trench was not properly reinforced. The contractor was found guilty of second-degree manslaughter and fined $10,000.00. The low penalty caused an uproar among workers' advocate groups. As a result, the penalties greatly increased for safety crimes.
The penalty increased by 50 times (at a minimum); the judge can levy on an employer as a result of a worker’s death or injury.
